Terms of Service

Effective Date: April 27, 2026

These Terms of Service ("Terms") govern your access to and use of the services provided by Omalius BV, a company incorporated under Belgian law, with registered office in Hasselt, Belgium ("Serwen", "we", "us", or "our").

By accessing or using Serwen, you agree to these Terms.

1. Eligibility

You must be at least 16 years old to use Serwen.

By using the service, you confirm that:

  • You meet this requirement
  • You have the legal capacity to enter into these Terms

Serwen may be used by individuals and businesses.

2. Accounts

You are responsible for:

  • Maintaining the confidentiality of your credentials
  • All activity under your account

You agree to provide accurate information and keep it up to date.

We may suspend or terminate accounts at our discretion, including for violations of these Terms.

3. Acceptable Use

You agree not to:

  • Use the service unlawfully
  • Generate harmful, abusive, or misleading content
  • Reverse engineer, scrape, or exploit the service
  • Bypass safeguards, limits, or security measures
  • Interfere with the integrity or performance of the service

4. AI Disclaimer

Serwen uses artificial intelligence systems.

You acknowledge that:

  • Outputs may be inaccurate, incomplete, or misleading
  • AI-generated content does not constitute professional advice
  • You are responsible for verifying outputs before relying on them
  • If you publish or distribute AI-assisted output, you remain responsible for any disclosure required by applicable law, platform rules, or internal policy

Chat, search, and custom expert features may all involve automated output generation.

5. Billing and Payments

Subscriptions

Subscriptions are billed in advance on a recurring basis (monthly or as specified at purchase).

Your subscription will automatically renew at the end of each billing period unless canceled before the renewal date.

Authorization

By subscribing, you authorize Serwen and its payment provider (for example, Stripe) to charge your payment method for all applicable fees.

Pricing and Taxes

Prices may change from time to time. Any changes will apply prospectively.

All fees are exclusive of applicable taxes, such as VAT, unless stated otherwise.

Credits

  • Subscription credits reset at the end of each billing cycle
  • Purchased credits do not expire unless stated otherwise at purchase

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

No refunds are provided for unused time, except where required by law.

Refunds and Withdrawal Rights

If you purchase digital services and request immediate access, you acknowledge that your statutory right of withdrawal may be lost or waived to the extent permitted by applicable law, including under EU consumer law.

Failed Payments

If a payment fails, we may suspend or limit access to the service until payment is successfully processed.

Chargebacks and Disputes

If you initiate a chargeback or payment dispute, we reserve the right to suspend your account and recover any outstanding amounts.

6. Ownership and Content

You retain ownership of your inputs and generated outputs.

You grant Serwen a limited, non-exclusive license to use your content solely to:

  • Operate and maintain the service
  • Improve performance and reliability
  • Ensure security and prevent abuse

We do not use your content to train AI models.

7. Service Availability

Serwen is provided on an "as is" and "as available" basis.

We do not guarantee that the service will be uninterrupted, secure, or error-free.

We may modify, suspend, or discontinue any part of the service at any time.

8. Beta Features

Some features may be labeled as beta or experimental.

These features:

  • May be unstable or incomplete
  • May change or be discontinued at any time
  • Are provided without guarantees

9. Termination

We may suspend or terminate your access if you:

  • Violate these Terms
  • Abuse the service
  • Fail to pay applicable fees

You may stop using the service at any time.

10. Limitation of Liability

To the maximum extent permitted by law, Serwen shall not be liable for:

  • Indirect or consequential damages
  • Loss of profits, data, or business opportunities

Our total liability is limited to the amount you paid to Serwen in the 12 months preceding the claim.

11. Abuse and Reporting

If you believe that any content or user is violating these Terms or applicable law, you may report it to contact@serwen.com.

We may investigate and take appropriate action, including removing content or suspending accounts.

12. Data Processing

To the extent Serwen processes personal data on your behalf, we act as a data processor under applicable data protection laws.

We will:

  • Process data only to provide the service
  • Implement reasonable technical measures to protect data
  • Not use your data for AI training

A more detailed Data Processing Agreement is available upon request.

13. Governing Law

These Terms are governed by the laws of Belgium.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Hasselt, Belgium.

14. Changes to These Terms

We may update these Terms from time to time.

If changes are material, we will provide notice. Continued use of the service constitutes acceptance of the updated Terms.
